Rapist faces the full wrath of the law for heinous crimes

The court declared the accused unfit to possess a firearm and ordered that his name be included in the National Register for Sex Offenders.

The National Prosecuting Authority (NPA) welcomes the life sentence imposed by the Eshowe Regional Court on a 33-year-old man following his conviction on charges of rape.

The court heard that, during July 2023, the accused raped the complainant, who was 11-years-old at the time, on several occasions in the Melmoth area. The accused was a friend of the complainant’s family.

Regional spokesperson of the National Prosecuting Authority, Natasha Ramkisson-Kara, said, “On two occasions, the accused took the complainant from her parents under the guise of taking her to town to buy clothes and to the tuck shop. He raped her along the way. In another incident, the accused was socialising with the complainant’s parents when the complainant’s father requested a pair of scissors from him. The accused then asked the complainant to accompany him to his house, where he raped her. During this incident, a nearby tenant heard the complainant crying and alerted her friends. Together, they intervened, took the accused and the complainant to the police station, and ensured that a criminal case was opened. The accused was subsequently arrested.”

The complainant’s parents were informed, and she was taken to hospital for a medical examination.

During the trial, Prosecutor Nomthandazo Mkhize led the evidence of the complainant and the tenant who had taken the accused and the complainant to the police station. The medical doctor who examined the complainant also testified, and the J88 medico-legal report was admitted into evidence.

“In aggravation of sentence, the prosecution submitted a victim impact statement (VIS), compiled by the complainant and facilitated by court preparation officer, Mandisa Paulette Sikakane. In her statement, the complainant described the profound impact of the offences on her life. She stated that she no longer feels human, experiences recurring flashbacks of her ordeal, and struggles to concentrate,” added Ramkisson-Kara.

In addition to the life sentence, the court declared the accused unfit to possess a firearm and ordered that his name be included in the National Register for Sex Offenders.

“The NPA welcomes the sentence imposed by the court, which reflects the seriousness of these offences and the devastating impact they have on victims,” concluded Ramkisson-Kara.
